Charles Tatham (1805-1846)

Will of 11 Jun 1846

I Charles Tatham
	of No 4 Albert Place Victoria Road Kensington in the county of Middlesex
	Army Accoutrement Maker
do hereby revoke all Wills Codicils and other testamentary dispositions
	at any time or times heretofore made by me
and declare this to be my last Will and Testament
I desire 
	if I die within twenty five miles of the Kensal Green Cemetery in the Harrow Road
	to be buried there in or near to my late fathers grave as conveniently can be
	and if I die at a greater distance than twenty five miles from Kensal Green 
then I desire 
	to be buried at such place and in such manner 
	as my dear wife Eliza Tatham shall think proper
I give and bequeath 
        unto my brother Henry Tatham 
	the sum of ten pounds ten shillings of lawful money current in the United Kingdom
and I give and bequeath 
        unto my brother Henry Tatham 
	all my goodwill of in and to my business 
	of an Army Accoutrement Maker and Sword Cutler
	together with all my right and interest 
	in and to the messuage or tenement situate and being 
	at No 37 on the west side of Charing Cross in the City of Westminster
	and being the corner house on the north side of Buckingham Court 
	as the same is now in the tenure and occupation 
	of my said Brother Henry Tatham and myself
	which said messuage or tenement is demised to me and my said brother 
	for the term of twenty one years
	from the twenty fourth day of June one thousand eight hundred and forty
	by Indenture of Lease 
	bearing date the twentieth day of March one thousand eight hundred and forty
	subject nevetheless to the said Henry Tatham 
	his creditors administrators and assigns 
	paying the rent and performing and fulfilling 
	all the covenants in the said Indenture of Lease
	and assuring and keeping my Executors and personal estate 
	harmless and indemnified 
	from all covenants and provisions 
	contained in the said Indenture of lease 
I give and bequeath 
       to the said Henry Tatham 
	all fixtures and fittings up 
	which may belong to me separately or jointly with my said brother Henry Tatham 
	in the said messuage and premises at Charing Cross aforesaid
	and affixed thereto or converted or used in my said business 
	of an Army Accoutrement Maker and Sword Cutler
	but which bequest I do not intend 
	to be reckoned into any gift of my stock in trade or book debts 
	which I wish shall be considered as part of my personal estate
I give and bequeath 
        unto my brothers Joseph Tatham and Ralph Tatham 
	the sum of ten pounds ten shillings each of like lawful money
I give and bequeath 
        unto my sisters Mary Ann Tatham Elizabeth Tatham and Sophia Tatham 
	and the survivors and survivor of them living at my decease
	the sum of fifty pounds to be divided between them share and share alike
	and if but one of them be living at my decease
	then I give and bequeath the said sum of fifty pounds to such one
I give and bequeath 
        unto my said dear wife Eliza Tatham 
	all my household goods furniture plate linen china books prints and pictures	
	and all such other effects belonging to me 
	as shall at the time of my decease be in or about my house 
	No 4 Albert Place aforesaid
	or any other house which may be my residence at the time of my decease 
	(except monies and securities for money and title or other deeds)
	and also my own and her wearing apparel jewels watches and personal ornaments 
	to and for her own use and benefit absolutely
And I give and bequeath 
        unto John Danby Christopher 
	of No 26a Argyll Street Regent Street in the said County of Middlesex
	Gentleman
	and Thomas Gurney Philpot
	of Nags Head Court Gracechurch Street in the City of London
	Insurance Broker
	and the survivor of them
	All my real estate 
	and all the Rest Residue and Remainder of my personal estate and effects 
	whatsoever and wheresoever or to which I or any person or persons in trust for me 
	shall at the time of my decease be possessed or entitled 
	or which I have power to dispose of or appoint by this my Will 
	whether in possession reversion remainder or expectancy unto 
	and to the use of 
	the said John Danby Christopher and Thomas Gurney Philpot and the survivor of them 
Upon trust nevertheless 
	that they the said John Danby Christopher and Thomas Gurney Philpot 
	do and shall with all convenient speed after my decease 
	call in dispose of and convert into money 
	such part thereof as shall not consist of ready money 
	and do and shall by and with and out of the money to arise and be procured therefrom 
	and the ready money of or to which 
	I shall be possessed or entitled at the time of my decease 
	pay satisfy and discharge my funeral and testamentary expenses 
	and all my just debts and the pecuniary legacies hereby bequeathed 
	or any legacy or legacies which I may 
	by any codicil or codicils to this my Will bequeath 
	and do and shall stand possessed of and interested in for surplus or residue 
	which shall remain of the same trust monies respectively
Upon trust 
	to pay the same to my said dear Wife Eliza Tatham 
	for her own absolute use and benefit
And I appoint 
	the said John Danby Christopher and Thomas Gurney Philpot and the survivor of them
	Executors of this my Will 
And I give and bequeath 
	unto the said John Danby Christopher and Thomas Gurney Philpot 
	the sum of ten pounds ten shillings 
	and provided they prove and take upon themselves the execution of this my Will
And I hereby authorize 
        my said Executors and the survivor of them 
	to compromise and compound with any person or persons 
	who shall be debtor or debtors accountant or accountants to 
	or who shall appear or pretend to be creditors or demandants upon my estate 
	upon such terms as my said Executors or the survivor of them shall think expedient 
	and to refer submit to reference or arbitration 
	any dispute or disputes relating to my estate 
	where the same shall appear necessary or desirable
And I declare and direct 
	that the said John Danby Christopher and Thomas Danby Philpot 
	shall be charged and chargeable with such sums only as they respectively receive 
	by virtue of the trust hereby reposed in them 
	notwithstanding their joining in signing any receipt or receipts 
	or doing any other act for the sake of conformity 
	and that they shall not be answerable or accountable 
	for any misfortune loss or damage which may happen 
	in the execution of the aforesaid trusts or in relation thereto 
except the same shall happen by or through his or their own wilful act neglect default
	and in that case each person alone shall be answerable for such loss or damage 
	as shall arise from his own neglect or default
And I further declare and direct 
	that it shall be lawful for them my said Executors or the survivor of them 
	by and out of the monies which shall come to their respective hands 
	under and by virtue of this my Will 
	to retain to and reimburse himself and themselves respectively 
	all costs charges damages and expenses 
	which they or either of them shall or may suffer sustain or be put to 
	in or about the execution of this my Will or in relation thereto
And I hereby further declare authorize and direct 
	that the said John Danby Christopher 
	shall be entitled to make the accustomed charges of a Solicitor or Attorney 
	for all business correspondence allowances matters and things 
	whether professional or otherwise 
	which he or which he and any partner or partners he may hereafter have 
	may or shall so make or transact 
	relative to my estate or the executorship or trusteeship aforesaid 
In witness whereof 
	I the said Charles Tatham
	to this my last Will and Testament
	contained in four sheets of paper
	have set my hand (that is to say)
	at the foot of each of the first three sheets hereof
	and at the end of this last sheet hereof
	this eleventh day of June 
	in the year of our Lord one thousand eight hundred and forty six

	who have attested and subscribed the same
	in his presence and in the presence of each other

This is a Codicil
	to the last Will and Testament
	of me the above named Charles Tatham
	which I desire to be taken and considered as part thereof
I give and bequeath
	to my dear sister in law Caroline Philpot
	the sum of three pounds three shillings
	to procure a ring to keep in remembrance of me
In witness whereof
	I the said Charles Tatham
	to this Codicil have set my hand
	this eleventh day of June 
	in the year of our Lord one thousand eight hundred and forty six

On the 22nd June 1847
Admon (with the Will and Codicil annexed)
	of the goods chattels and assets 
	of Charles Tatham
	formerly of Albert Place Kensington 
	but late of 37 Charing Cross
	and of 52 Stanhope Street Hampstead Road 
	in the parish of St Pancras in the county of Middlesex
was granted to
	Walter Williams
	a creditor of the said deceased
	having been first sworn duly to administer
John Danby Christopher and Thomas Gurney Philpot
	the Executors and Residuary Legatees in trust
	having first renounced the Probate and Execution of the said Will and Codicil
	and also the letters of Admon 
	with the said Will and Codicil annexed 
	of the goods of the said deceased 
and Eliza Tatham 
	widow and Relict and the residuary legatee named in the said Will 
	having also renounced the said letters of Admon
	with the said Will and Codicil annexed 
	of the goods of the said deceased
