This is the last Will and Testament of me Charles Meaburn Tatham of Emberton Newport Pagnell in the County of Buckingham Barrister at Law
I appoint my daughter Jessie Elizabeth Tatham my son Meaburn Talbot Tatham and my grandson Meaburn Tatham (hereinafter called my trustees) to be Executors and Trustees of this my will
I bequeath all my wines liquors and consumable stores unto my wife Elizabeth Tatham if she shall survive me but if not then to my said daughter
I bequeath all my pictures plate linen china glass books prints furniture and household effects unto my said wife during her life and after her death to my said daughter during her life each tenant for life while in possession insuring and keeping the same insured against loss or damage by fire in the full value thereof in the name of my trustees
And after the decease of my said wife and daughter I bequeath the same unto my said son Meaburn Talbot Tatham
I bequeath unto my said wife a legacy of five hundred pounds to be paid immediately after my decease and to my said grandson the sum of two hundred and fifty pounds free of duty
In pursuance of the power enabling me in this behalf contained in the will of my late father I hereby appoint that the income of the sum of ten thousand pounds (by such will directed to be raised out of my one sixth share of and in my late fathers residuary real and personal estate and to be held upon the trusts for the benefit of myself and children therein set forth) or of the investments representing such sum shall be paid unto my said wife during her life
I devise my farm called Norwood Farm consisting of about one hundred and ten acres situate near Effingham in the County of Surrey together with the copyhold cottage orchard and premises held therewith unto and to the use of my said son Meaburn Talbot his heirs and assigns for ever
I bequeath an annuity of three hundred and fifty pounds unto my said daughter during her life to commence from my decease, and to be paid by equal quarterly payments the first payment to be made at the expiration of three calendar months from my decease such annuity to be for my said daughters separate use independently of any husband and without power of anticipation
And I direct my trustees to set apart and invest in any of the securities hereinafter authorized funds sufficient at the period of appropriation to produce by the income thereof the said annuity and to apply the income and at my trustees discretion the capital of the funds so set apart in payment of the said annuity and until such setting apart and investment as aforesaid
I direct my trustees to pay the said annuity out of my residuary estate hereinafter devised and bequeathed And I further direct that on the cesser of the said annuity the funds so appropriated and set apart as aforesaid shall accrue and be added to the one moiety of my said residuary estate hereinafter devised and bequeathed to my said daughter and my sons issue
I devise and bequeath all my real and personal estate whatsoever of or to which I shall at my decease be possessed or beneficially entitled or over which I shall at my decease have a general power of disposition by will (except what I otherwise dispose of by this my will or any codicil thereto) Unto my trustees
Upon trust that my trustees shall sell call in and convert into money the same or such part thereof as shall not consist of money and shall out of the moneys produced by such sale calling in and conversion and out of my ready money pay my funeral and testamentary expenses and debts and the legacies bequeathed by this my will or any codicil hereto and shall stand possessed of the residue of the said moneys
Upon the trusts following that is to say
As to one equal moiety of the said residuary trust moneys In trust for my said son Meaburn Talbot Tatham his executors administrators and assigns
And as to the remaining equal moiety of the same residuary trust moneys Upon and for the trusts and purposes hereinafter declared
And I declare that my trustees shall invest the last named equal moiety in any investments or securities for the time being authorised by law for trust money and may in their discretion from time to time vary and transpose the investments thereof and shall pay the income of such last mentioned one equal moiety or of the investments representing the same to my said daughter Jessie Elizabeth Tatham for her life for her separate use independently of any husband and without power of anticipation but with power for her to appoint by will or codicil that after her decease the Income of any part not exceeding one half of such last mentioned equal moiety shall be paid to any husband of hers who may survive her during his life or any leas period
And after the decease of my said daughter and subject to any appointment which may be made to her husband as aforesaid I direct my trustees to stand possessed of the last mentioned equal moiety In trust for such one or more exclusively of the other or others of the children or remoter issue of my said son such remoter issue to be born and take vested interests within the time allowed by law as my said daughter shall by deed with or without power of revocation and new appointment or by will appoint and subject thereto and in so far as no such appointment shall extend In trust for the children of my said son who being male attain the age of twenty one years or being female attain that age or marry under that age with the consent of their his or her guardians for the time being In equal shares and if there shall be only one such child the whole to be in trust for that one child But so nevertheless that no child who or any of whose issue shall take a share under any such appointment as aforesaid sha11 take any part of the trust fund remaining unappointed without bringing the share appointed to him or her or to his or her issue into hotchpot and accounting for the same accordingly unless my said daughter in making such appointment as aforesaid shall direct the contrary
And I hereby declare that my trustees may postpone the sale and conversion of all or any part of my residuary real and personal estate respectively as long as they shall think proper but my residuary real estate if any shall be considered as personalty as from the time of my decease and during such postponement my trustees may until sale of my residuary real estate if any (including chattels real) manage and let upon lease the same respectively for any term not exceeding twenty one years
And I declare that the net rents and profits and other income produced from every or any part of my real or personal estate previously to the conversion or collection thereof shall (after payment thereout of all necessary outgoings and incidental expenses relating thereto) be applied in the same manner in all respects as if the same were income arising from the produce of such conversion or collection
And I further declare that my trustees may instead of selling the same appropriate and allot in such manner as they may deem fair and proper my shares in the City of London Real Property Company Limited or any of them or any other my shares or stocks or securities or any of them or any other part of my property in or towards satisfaction of the share in my estate hereby given in favour of my son and daughter respectively and that the share or shares stock securities or property which shall be appropriated and allotted in or towards satisfaction of the share in my residuary estate hereinbefore directed to be held in trust as aforesaid shall remain vested in my trustees and the income thereof shall be applied upon the trusts and subject to the powers and provisoes (Including the power of varying investments) upon with and subject to which the investments hereinbefore authorised to be purchased as aforesaid by or out of such share and the income thereof are or is hereinbefore directed to be held and applied respectively

This is a Codicil to the last will and testament of me Charles Meaburn Tatham of Emberton Newport Pagnell in the County of Buckingham Barrister at Law which will bears date the eleventh day of July one thousand nine hundred and ten
Whereas by my said will I have bequeathed to my daughter Jessie Elizabeth Tatham an annuity of three hundred and fifty pounds during her life and I directed my trustees to stand possessed of the funds set apart to answer such annuity Upon certain trusts mentioned in my said will
Now I hereby bequeath to my said daughter Jessie Elizabeth Tatham an annuity of one thousand pounds in lieu of the said annuity of three hundred and fifty pounds given her as aforesaid and I direct that my said will shall be read and construed in all respects as if an annuity of one thousand pounds had been bequeathed to her thereby instead of three hundred and fifty pounds and as if I had thereby directed sufficient funds to be set apart to answer the same and to be held upon the trusts thereby declared I devise all copyhold hereditaments vested in me as trustee or mortgagee to the use of such person or persons as the trustees or trustee for the time being of my said will shall within twenty one years after my death by any deed or deeds appoint and in default of and until such appointment I devise the same unto my said trustees or trustee subject to the trusts and equities affecting the same respectively and so that the money secured on any mortgage shall be deemed part of my personal estate
And in all other respects I confirm my said will

This is a Second Codicil to the last will of me Charles Meaburn Tatham of Emberton Newport Pagnell in the County of Buckingham Barrister at Law which will bears date the eleventh day of July one thousand nine hundred and ten the first codicil thereto being dated the seventh day of February one thousand nine hundred and eleven
Whereas I wish to make some provision after my death for Ellen Beale an orphan adopted by some Sisters of Mercy and since her childhood living with Mabel Alice Bongard generally known as Sister Mabel or elsewhere as a lady nurse
Now I declare that in case the said Sister Mabel and my daughter Jessie Elizabeth Tatham or either of them as well as the said Ellen Beale shall be living at my death the trustees or trustee for the time being of my said will shall during the lives or life of the said Sister Mabel and my said daughter or of the survivor of them so long as the said Ellen Beale be living pay to the said Sister Mabel and my said daughter or to the survivor of them such yearly sum not exceeding in any one year fifty pounds as the said Sister Mabel and my said daughter or the survivor of them shall request the said trustees or trustee to advance every such annual sum to be applied by the said Sister Mabel and my said daughter or the survivor of them at their or her absolute discretion for the benefit of the said Ellen Beale in such way and manner as the said Sister Mabel and my said daughter or the survivor of them shall think fit
And I further declare that after the death of the survivor of the said sister Mabel and my said daughter the trustees or trustee for the time being of my said will shall in case the said Ellen Beale be then living raise out of my personal estate a sum of money sufficient for the purpose and apply the same in the purchase of a Government annuity of fifty two pounds a year in the name of the said Ellen Beale for the then remainder of her life for her sole use and benefit and in payment of the legacy duty thereon
And in all other respects I confirm my said will as altered by the said first codicil and also the said first codicil

This is a Third Codicil to the last will of me Charles Meaburn Tatham of Emberton Bucks and Cary Castle Torquay which will bears date the 11th day of July 1910 the first and second codicils thereto being dated respectively the 7th day of February 1911 and the 22nd day of June 1916
I hereby give and bequeath to Nurse Adelaide Gertrude Toms who has been for some time past attending me as a Nurse an annuity of thirty pounds (free of legacy duty) during her life the first half yearly payment to be made at the end of six months after my death
I confirm my said will as altered by the said first codicil and also the said first and second codicils
In Witness whereof I have hereunto set my hand this 14th day of September 1920 - C M Tatham -
Signed by the said testator as a third codicil to his will in the presence of us who present at the same time in his presence and in the presence of each other have hereunder subscribed our names as witnesses - Mabel Alice Bongard Cary Castle St Marychurch (Sister of Mercy) - Margaret Combe Cary Castle St Mary Church (Sister of Mercy).

This is a Fourth Codicil to the will of me Charles Meaburn Tatham of Cary Castle Torquay in the County of Devon Esquire which will is dated the eleventh day of July one thousand nine hundred and ten
I bequeath a legacy of one hundred pounds (100) free of duty to my gardener John Davenport and a legacy of thirty pounds (30) free of duty to my Chauffeur _ Lovell if each of them is in my service at the time of my death
In all other respects I confirm my said will as altered by the first codicil thereto and I also confirm the three previous codicils thereto

Signed by the said Charles Meaburn Tatham the testator as and for a fourth codicil to his last will and testament in the presence of us both present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses - Jessie Elizabeth Tatham Gary Castle St Mary Church S Devon Spinster - Adelaide Gertrude Toms at Cary Castle St Mary Church Nurse.

On the 12th day of September 1924 Probate of this will (with four codicils thereto) was granted to Jessie Elizabeth Tatham Meaburn Talbot and Meaburn Tatham the executors.

Be it known that Charles Meaburn Tatham of Cary Castle St Marys Church Torquay in the County of Devon died there on the 12th day of July 1924.

And be it further known that at the date hereunder written the last Will and Testament with four codicils thereto of the said deceased was proved and registered in the Principal Probate Registry of His Majesty's High Court of Justice, and that administration of all the estate which by law devolves and vests in the personal representative of the said deceased was granted by the aforesaid Court to Jessie Elizabeth Tatham of the same address Spinster Daughter and Meaburn Talbot Tatham of Northcourt Abingdon in the County of Berks Esquire Son and Meaburn Tatham of Ardnacombe 111 Middleton Hall Road Kings Norton Birmingham in the County of Warwick Esquire Grandson of deceased the Executors named in the said Will.

Dated the 12th day of September 1924.
